No, unpaid leave days are not counted when calculating your gratuity (end-of-service benefit) in Dubai or anywhere in the
gratuity UAE.
Under Article 51 of UAE Federal Decree Law No. 33 of 2021 (Regulating Labour Relations), gratuity is calculated based on the period of actual service rendered by the employee.
The law specifically excludes any unpaid periods of absence from the calculation of continuous service.
